Complex Motions
I am a solo practitioner who works predominately on appeals and complex motions in California courts (all levels) and federal appeals courts nationwide. I have been in practice for more than 30 years and have handled appellate matters since 1979.
While every attorney may be qualified to represent a client on appeal, not every lawyer has the time, experience, expertise or even the temperament to litigate cases on appeal. Appeals typically require intensive research; an even greater analysis of the issues than is required in the trial court; an experienced understanding of the applicable standard of appellate review applicable to each issue, and to each ruling or determination in the trial court; and a working familiarity with the many procedural issues that may arise on appeal. Many of the cases take years to resolve. Attorneys and law firms will often contract with a solo practitioner who focuses on appeals cases because working with a specialist is more cost-effective for them and their clients. Furthermore, an appeals specialist will likely produce a higher quality work product than someone who is not an appeals specialist. The quality of the work product often has a significant impact on the outcome or result of the appeal.
It is also frequently advisable for an appeals attorney to become involved with the case while it is still in the trial court, so that the case may be properly prepared for appeal by the infusion of additional arguments and issues that may have been previously overlooked. Such an infusion may often be accomplished by means of a motion for new trial or other, similar, motion. An appeals attorney is oftentimes able to provide a “second opinion” on the legal aspects and posture of the case.
I have worked with a number of Los Angeles law firms and welcome attorney referrals. I also accept select appeals cases directly from plaintiffs and defendants who have received adverse results in the trial court and may be seeking an attorney to help them bring their cases to a higher court. I have written briefs and argued before the court in approximately 80 cases on appeal; more than 15 of these have resulted in published opinions. I handle a wide range of civil matters - appeals and complex motions - in a variety of areas: all forms of torts, including products liability; insurance coverage, including bad faith issues; consumer law; civil rights and Constitutional law; construction defect law; banking and collections; administrative law; the numerous issues of civil procedure that arise; and many other areas.
